20. y\u00fczy\u0131lda ya\u015fanan teknolojik geli\u015fmeler ile ba\u015flayan ve g\u00fcn\u00fcm\u00fcz\u00fcn\nen \u00f6nemli k\u00fcresel sorunlar\u0131ndan biri olan \u00e7evre kirlili\u011fi; d\u00fcnyam\u0131z\u0131n kar\u015f\u0131\nkar\u015f\u0131ya oldu\u011fu varsay\u0131msal tehditlerin yakla\u015fmas\u0131yla daha da \u00f6nemli bir hale\ngelmi\u015ftir. \u00c7evre sorunlar\u0131nda meydana gelen olumsuzluklar\u0131n g\u00f6z ard\u0131\nedilemeyecek seviyelere ula\u015fmas\u0131yla \u00e7evre sorunlar\u0131 hukuki \u00e7er\u00e7evede yerini\nalm\u0131\u015ft\u0131r. <\/p>\n\n\n\n

1913 y\u0131l\u0131nda yap\u0131lan Bern Konferans\u0131 bu \u00e7al\u0131\u015fmalar\u0131n\nilkidir. Birle\u015fmi\u015f Milletler \u00c7evre ve \u0130nsan Konferans\u0131 uluslararas\u0131 alanda\n\u00e7evre hakk\u0131n\u0131n dile getirildi\u011fi ilk toplant\u0131d\u0131r. Toplant\u0131ya 100\u2019den fazla \u00fclke\ntemsilcisi kat\u0131lm\u0131\u015ft\u0131r. Bu toplant\u0131;\n\u201c\u0130nsan, onurlu ve iyi bir ya\u015fam s\u00fcrmeye olanak veren nitelikli bir \u00e7evrede,\n\u00f6zg\u00fcrl\u00fck, e\u015fitlik ve yeterli ya\u015fam ko\u015fullar\u0131 temel hakk\u0131na sahiptir.\u201d (m.1)\nilkesinin yer ald\u0131\u011f\u0131 bildirinin kabul edilmesi nedeni ile \u00e7evre sorunlar\u0131na\ny\u00f6nelik politika aray\u0131\u015f\u0131nda ayr\u0131 bir \u00f6neme sahiptir.<\/p>\n\n\n\n

\u00dclkemizdeki\ngeli\u015fmeler 1982 Anayasas\u0131 ile birlikte anayasal bir d\u00fczene ta\u015f\u0131nm\u0131\u015ft\u0131r. Anayasam\u0131z\u0131n\n56. Maddesinde koruma alt\u0131na al\u0131nan \u00e7evreyi geli\u015ftirmek, \u00e7evre sa\u011fl\u0131\u011f\u0131n\u0131\nkorumak ve \u00e7evre kirlenmesini \u00f6nlemek \u00f6devi vatanda\u015flara ve devlete\nverilmi\u015ftir. Devlet; \u00e7evre ile ilgili d\u00fczenlemeler yapt\u0131ktan sonra bu\nd\u00fczenlemelere uyulup uyulmad\u0131\u011f\u0131n\u0131 kontrol etmek, denetlemek ve gerekli\ntedbirleri almak, uyulmad\u0131\u011f\u0131 takdirde de cayd\u0131r\u0131c\u0131 ve tazmin etkisi olan\nyapt\u0131r\u0131mlar\u0131 uygulamak zorundad\u0131r.  <\/p>\n\n\n\n

09.08.1983\ntarihinde 2872 say\u0131l\u0131 \u00c7evre Kanunu yay\u0131mlanm\u0131\u015ft\u0131r. Bu Kanununa istinaden bir\u00e7ok\nY\u00f6netmelik, Genelge ve Tebli\u011f yay\u0131nlanmaya devam etmektedir.<\/p>\n\n\n\n

\u0130DAR\u0130\nPARA CEZASI VE \u00c7E\u015e\u0130TLER\u0130: <\/strong><\/p>\n\n\n\n

\u0130dari\npara cezas\u0131, kanunda kabahat olarak nitelendirilen haks\u0131z fiiller kar\u015f\u0131l\u0131\u011f\u0131nda,\nkanunla belirlenen parasal nitelikteki yapt\u0131r\u0131mlard\u0131r ve iki \u00e7e\u015fidi\nbulunmaktad\u0131r. Bunlar; maktu ve nispi idari para cezalar\u0131d\u0131r. Maktu idari para\ncezas\u0131; Kabahatler Kanunu m.17\/1 uyar\u0131nca, cezan\u0131n ilgili kanun gere\u011fi sabit\nolarak belirlenmi\u015f olmas\u0131d\u0131r. Nispi idari para cezas\u0131; Kabahatler Kanunu m.17\/2\nuyar\u0131nca, belli bir oran ile hesaplanan idari para cezalar\u0131d\u0131r.<\/p>\n\n\n\n

31 Aral\u0131k 2019 tarihli 30995 Say\u0131l\u0131 Resmi Gazete yay\u0131mlanan 2020\ny\u0131l\u0131na ili\u015fkin ceza tutarlar\u0131n\u0131n yer verdi\u011fi tablo a\u015fa\u011f\u0131daki gibidir.<\/p>\n\n\n\n

\u00c7evre Kanunu\u2019nun \u201c\u0130dari cezalarda yetki\u201d ba\u015fl\u0131kl\u0131 24.\nMaddesinde idari para cezas\u0131 verme yetkisine sahip birimler a\u00e7\u0131klanm\u0131\u015ft\u0131r.\n\u0130lgili 24. Maddede denetim yetkisinin devrine ili\u015fkin olarak ayn\u0131 Kanunun 12.\nMaddesine at\u0131f yap\u0131lm\u0131\u015ft\u0131r. 12. Maddeye g\u00f6re \u00c7evre Kanunu h\u00fck\u00fcmlerine uyulup\nuyulmad\u0131\u011f\u0131n\u0131 denetleme yetkisi \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131na ait olup,\ngerekti\u011finde bu yetkinin Bakanl\u0131k\u00e7a; il \u00f6zel idarelerine, \u00e7evre denetim\nbirimlerini kuran belediye ba\u015fkanlar\u0131na, Denizcilik M\u00fcste\u015farl\u0131\u011f\u0131na, Sahil\nG\u00fcvenlik Komutanl\u0131\u011f\u0131na, 13\/10\/1983 tarihli ve 2918 say\u0131l\u0131 Karayollar\u0131 Trafik\nKanuna g\u00f6re belirlenen denetleme g\u00f6revlilerine devredilece\u011fi, denetimlerin\nBakanl\u0131\u011f\u0131n belirledi\u011fi denetim usul ve esaslar\u0131 \u00e7er\u00e7evesinde yap\u0131laca\u011f\u0131 h\u00fck\u00fcm\nalt\u0131na al\u0131nm\u0131\u015ft\u0131r. 12. Maddenin son f\u0131kras\u0131nda da \u201cDenetim bilgi verme ve\nbildirim y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ili\u015fkin usul ve esaslar Bakanl\u0131k\u00e7a \u00e7\u0131kar\u0131lacak\ny\u00f6netmeliklerle d\u00fczenlenir.\u201d denilmektedir. Bu maddeye istinaden \u00c7evre ve\n\u015eehircilik Bakanl\u0131\u011f\u0131 taraf\u0131ndan \u00e7\u0131kar\u0131lan, yay\u0131m tarihi 03.04.2007 tarihli \u201c\u00c7evre\nKanunu\u2019na G\u00f6re Verilecek \u0130dari Para Cezalar\u0131na \u0130hlalin Tespiti ve Ceza\nVerilmesi ile Tahsili Hakk\u0131nda Y\u00f6netmeli\u011fin\u201d ikinci b\u00f6l\u00fcm\u00fcnde \u201cidari para\ncezas\u0131 verme yetkisi\u201d ba\u015fl\u0131\u011f\u0131 alt\u0131nda ceza verme\/kesme yetkisi; bakanl\u0131kta\nidari para cezas\u0131 verme yetkisi (madde 5) ve bakanl\u0131k d\u0131\u015f\u0131nda idari para cezas\u0131\nverme yetkisi (madde 6) olarak iki ba\u015fl\u0131kta d\u00fczenlenmi\u015ftir. Bahsi ge\u00e7en\ny\u00f6netmeli\u011fin 5. Maddesi uyar\u0131nca, kanunda belirtilen ihlaller i\u00e7in idari para\ncezas\u0131 kesme yetkisi; Bakanl\u0131k merkez te\u015fkilat\u0131nda \u00c7evre Y\u00f6netimi Genel\nM\u00fcd\u00fcr\u00fc, \u00c7evresel Etki De\u011ferlendirmesi ve Planlama Genel M\u00fcd\u00fcr\u00fc ile Do\u011fa Koruma\nve Mill\u00ee Parklar Genel M\u00fcd\u00fcr\u00fc, ta\u015fra te\u015fkilat\u0131nda ise \u00c7evre ve Orman \u0130l M\u00fcd\u00fcr\u00fc\ntaraf\u0131ndan verilece\u011fi a\u00e7\u0131k\u00e7a belirtilmi\u015ftir. Ancak 04.07.2011 tarihli ve 27984\nsay\u0131l\u0131 m\u00fckerrer Resmi Gazetede yay\u0131mlanan, 29.06.2011 tarih ve 644 no.lu \u201c\u00c7evre\nve \u015eehircilik Bakanl\u0131\u011f\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde\nKararnamede\u201d yap\u0131lan d\u00fczenlemeler ile \u00c7evre Kanunu kapsam\u0131nda idari para cezas\u0131\nverebilecek birimler yeniden d\u00fczenlenmi\u015ftir.
