Koronavir\u00fcs t\u00fcm d\u00fcnya ile birlikte \u00fclkemizi de tehdit eder bir hal alm\u0131\u015ft\u0131r. \u0130nsan hayat\u0131n\u0131n bir\u00e7ok alan\u0131n\u0131 do\u011frudan etkileyen Koronavir\u00fcs salg\u0131n\u0131n\u0131n hukuki boyutu olduk\u00e7a \u00f6nem arz etmektedir. Bu \u00e7al\u0131\u015fmam\u0131zda \u00e7al\u0131\u015fanlar\u0131n ve i\u015fverenlerin Koronavir\u00fcs salg\u0131n\u0131 nedeniyle kar\u015f\u0131la\u015fabilece\u011fi hukuki sorunlar ve bu sorunlar\u0131n i\u015f akitlerine olas\u0131 etkileri incelenerek \u0130\u015f Hukuku mevzuat\u0131m\u0131z kapsam\u0131nda a\u00e7\u0131klamalar yap\u0131lacakt\u0131r. <\/p>\n\n\n\n

  1. Koronavir\u00fcs Ta\u015f\u0131yan veya Risk Alt\u0131nda Bulunan \u00c7al\u0131\u015fan\u0131n Y\u00fck\u00fcml\u00fcl\u00fckleri<\/strong><\/li><\/ol>\n\n\n\n

    \u00c7al\u0131\u015fanlar\u0131n, di\u011fer \u00e7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fini sa\u011flama amac\u0131na y\u00f6nelik olarak i\u015fbirli\u011fi yapma ve sadakat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. 6331 Say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun \u2018\u2019\u00c7al\u0131\u015fanlar\u0131n Y\u00fck\u00fcml\u00fcl\u00fckleri\u2019\u2019 ba\u015fl\u0131kl\u0131 19. Maddesi uyar\u0131nca \u2018\u2019\u00c7al\u0131\u015fanlar, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili ald\u0131klar\u0131 e\u011fitim ve i\u015fverenin bu konudaki talimatlar\u0131 do\u011frultusunda, kendilerinin ve hareketlerinden veya yapt\u0131klar\u0131 i\u015ften etkilenen di\u011fer \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenliklerini tehlikeye d\u00fc\u015f\u00fcrmemekle y\u00fck\u00fcml\u00fcd\u00fcr.\u2019\u2019<\/em><\/strong><\/p>\n\n\n\n

    Bu nedenle Koronavir\u00fcs semptomlar\u0131na sahip \u00e7al\u0131\u015fanlar\u0131n ivedilikle durumu i\u015fverenlerine bildirmeleri gerekmektedir. Aksi takdirde \u00e7al\u0131\u015fan sadece kendi sa\u011fl\u0131\u011f\u0131n\u0131 tehlikeye atmayacak olup, ayn\u0131 zamanda di\u011fer \u00e7al\u0131\u015fanlar\u0131n da i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fini ciddi derecede tehlikeye d\u00fc\u015f\u00fcrecektir.<\/p>\n\n\n\n

    1. \u0130\u015fverenin Koronavir\u00fcs Nedeniyle Y\u00fck\u00fcml\u00fcl\u00fckleri<\/strong><\/li><\/ol>\n\n\n\n

      6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun \u201c\u0130\u015f\u00e7inin Ki\u015fili\u011finin Korunmas\u0131\u201d ba\u015fl\u0131kl\u0131 417. maddesinin 2. f\u0131kras\u0131nda i\u015fverenin, \u00e7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ile g\u00fcvenli\u011fini sa\u011flamas\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc yer almaktad\u0131r.<\/p>\n\n\n\n

      TBK madde 417\/2 : \u201c\u0130\u015fveren, i\u015fyerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in gerekli her t\u00fcrl\u00fc \u00f6nlemi almak, ara\u00e7 ve gere\u00e7leri noksans\u0131z bulundurmak; i\u015f\u00e7iler de i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunda al\u0131nan her t\u00fcrl\u00fc \u00f6nleme uymakla y\u00fck\u00fcml\u00fcd\u00fcr.\u201d <\/em><\/strong><\/p>\n\n\n\n

      6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun \u2018\u2019\u0130\u015fverenin Genel Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc\u2019\u2019 ba\u015fl\u0131kl\u0131 4. Maddesinde de \u0130\u015fverenin \u00e7al\u0131\u015fanlar\u0131n i\u015fle ilgili sa\u011fl\u0131k ve g\u00fcvenli\u011fini sa\u011flamakla y\u00fck\u00fcml\u00fc oldu\u011fu yer almaktad\u0131r. <\/p>\n\n\n\n

      \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu<\/strong> Madde 4 : <\/em><\/strong><\/p>\n\n\n\n

      (1)<\/em><\/strong> \u0130\u015fveren, \u00e7al\u0131\u015fanlar\u0131n i\u015fle ilgili sa\u011fl\u0131k ve g\u00fcvenli\u011fini sa\u011flamakla y\u00fck\u00fcml\u00fc olup bu \u00e7er\u00e7evede;<\/em><\/p>\n\n\n\n

      a)<\/em><\/strong> Mesleki risklerin \u00f6nlenmesi, e\u011fitim ve bilgi verilmesi d\u00e2hil her t\u00fcrl\u00fc tedbirin al\u0131nmas\u0131, organizasyonun yap\u0131lmas\u0131, gerekli ara\u00e7 ve gere\u00e7lerin sa\u011flanmas\u0131, sa\u011fl\u0131k ve g\u00fcvenlik tedbirlerinin de\u011fi\u015fen \u015fartlara uygun hale getirilmesi ve mevcut durumun iyile\u015ftirilmesi i\u00e7in \u00e7al\u0131\u015fmalar yapar.<\/em><\/p>\n\n\n\n

      b)<\/em><\/strong> \u0130\u015fyerinde al\u0131nan i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirlerine uyulup uyulmad\u0131\u011f\u0131n\u0131 izler, denetler ve uygunsuzluklar\u0131n giderilmesini sa\u011flar.<\/em><\/p>\n\n\n\n

      c)<\/em><\/strong> Risk de\u011ferlendirmesi yapar veya yapt\u0131r\u0131r.<\/em><\/p>\n\n\n\n

      \u00e7)<\/em><\/strong> \u00c7al\u0131\u015fana g\u00f6rev verirken, \u00e7al\u0131\u015fan\u0131n sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden i\u015fe uygunlu\u011funu g\u00f6z \u00f6n\u00fcne al\u0131r.<\/em><\/p>\n\n\n\n

      d)<\/em><\/strong> Yeterli bilgi ve talimat verilenler d\u0131\u015f\u0131ndaki \u00e7al\u0131\u015fanlar\u0131n hayati ve \u00f6zel tehlike bulunan yerlere girmemesi i\u00e7in gerekli tedbirleri al\u0131r.<\/em><\/p>\n\n\n\n

      \u0130\u015fverenlerin TBK\u2019n\u0131n 417. maddesi ve \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun 4. maddesi uyar\u0131nca i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in gerekli \u00f6nlemleri almak, \u00e7al\u0131\u015fanlar\u0131n i\u015fle ilgili sa\u011fl\u0131k ve g\u00fcvenli\u011fini sa\u011flamak ve mesleki risklerin \u00f6nlenmesi, e\u011fitim ve bilgi verilmesi dahil her t\u00fcrl\u00fc tedbirin al\u0131nmas\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. Bu nedenle i\u015fveren e\u011fer bir \u00e7al\u0131\u015fan\u0131n\u0131n enfekte oldu\u011fundan \u015f\u00fcpheleniyor ise i\u015fyeri hekimine, i\u015fyerinde i\u015fyeri hekimi bulunmuyor ise sa\u011fl\u0131k g\u00f6revlilerine durumu bildirmesi gerekmektedir. Ayr\u0131ca i\u015fveren risk alt\u0131nda bulunan \u00e7al\u0131\u015fanlar\u0131ndan koronavir\u00fcse y\u00f6nelik olarak t\u0131bbi kontrolden ge\u00e7meleri talebinde bulunabilir.<\/p>\n\n\n\n

      1. \u00c7al\u0131\u015fan\u0131n Koronavir\u00fcs Nedeniyle \u0130\u015f Seyahatlerine veya Toplant\u0131lara Kat\u0131lmaktan Ka\u00e7\u0131nmas\u0131<\/strong><\/li><\/ol>\n\n\n\n

        \u0130\u015f seyahatleri ve i\u015f toplant\u0131lar\u0131n\u0131n y\u00fcksek risk i\u00e7ermesi veya g\u00fcvenli olmad\u0131\u011f\u0131 kabul edilen yerlerde ger\u00e7ekle\u015fecek olmas\u0131 durumunda \u00e7al\u0131\u015fan kat\u0131lmay\u0131 reddedebilir. \u0130\u015fveren, \u00e7al\u0131\u015fan bu yerlere gitmedi\u011fi i\u00e7in, i\u015f\u00e7inin g\u00f6revini yerine getirmemesi gerek\u00e7esiyle i\u015f s\u00f6zle\u015fmesini feshedemeyecek veya \u00e7al\u0131\u015fana kar\u015f\u0131 herhangi bir yapt\u0131r\u0131m uygulayamayacakt\u0131r.<\/p>\n\n\n\n

        1. \u0130\u015fyerinde Faaliyetin Sonradan Telafi Edilmek \u00dczere Belirli Bir S\u00fcre Durdurulmas\u0131 <\/strong><\/li><\/ol>\n\n\n\n

          \u0130\u015fyerinde zorunlu nedenlerle faaliyetin ge\u00e7ici olarak durdurulmas\u0131 veya tamamen tatil edilmesi sebebiyle \u0130\u015f Kanunu\u2019nun 64. Maddesi uyar\u0131nca iki ay i\u00e7inde \u00e7al\u0131\u015f\u0131lmayan s\u00fcreler telafi edilmek \u00fczere telafi \u00e7al\u0131\u015fmas\u0131 ger\u00e7ekle\u015ftirebilir. (18 Mart 2020 tarihli Koronavir\u00fcs De\u011ferlendirme Toplant\u0131s\u0131\u2019nda al\u0131nan karar neticesinde istihdamdaki s\u00fcreklili\u011fi temin etmek amac\u0131yla 2 ayl\u0131k telafi \u00e7al\u0131\u015fma s\u00fcresi 4 aya \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.) <\/p>\n\n\n\n

          \u0130\u015f Kanunu\u2019na \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi’nin 7. maddesi uyar\u0131nca telafi \u00e7al\u0131\u015fmas\u0131n\u0131n:<\/p>\n\n\n\n

          –<\/strong> Kayna\u011f\u0131n\u0131 olu\u015fturan zorunlu nedenin ortadan kalkmas\u0131 ve i\u015fyerinin normal \u00e7al\u0131\u015fma d\u00f6nemine ba\u015flamas\u0131n\u0131 takip eden 2 ay i\u00e7erisinde yapt\u0131r\u0131lmas\u0131, (18 Mart 2020 tarihli Koronavir\u00fcs De\u011ferlendirme Toplant\u0131s\u0131\u2019nda al\u0131nan karar neticesinde istihdamdaki s\u00fcreklili\u011fi temin etmek amac\u0131yla 2 ayl\u0131k telafi \u00e7al\u0131\u015fma s\u00fcresi 4 aya \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.)<\/p>\n\n\n\n

          -\u0130\u015f durdurma sona erdi\u011finde \u00e7al\u0131\u015fanlar\u0131n toplam g\u00fcnl\u00fck \u00e7al\u0131\u015fman\u0131n 11 saati \t        a\u015fmamas\u0131,<\/p>\n\n\n\n

          -Telafi \u00e7al\u0131\u015fma s\u00fcresinin 3 saatten fazla olmamas\u0131<\/p>\n\n\n\n

          -Tatil g\u00fcnlerinde yapt\u0131r\u0131lmamas\u0131<\/p>\n\n\n\n

          gerekmektedir. \u0130\u015fveren yine \u0130\u015f Kanunu\u2019na \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi’nin 7. maddesi uyar\u0131nca bu \u00e7al\u0131\u015fman\u0131n 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 64. maddesinde say\u0131lan nedenlerden hangisine dayand\u0131\u011f\u0131n\u0131 a\u00e7\u0131k olarak belirtmek, hangi tarihte \u00e7al\u0131\u015fmaya ba\u015flanaca\u011f\u0131n\u0131, ilgili i\u015f\u00e7ilere bildirmek zorundad\u0131r. Bu s\u00fcre\u00e7te bir problem ile kar\u015f\u0131la\u015fmamak ad\u0131na \u00e7al\u0131\u015fan\u0131n telafi \u00e7al\u0131\u015fmas\u0131na y\u00f6nelik yaz\u0131l\u0131 onay\u0131n\u0131n al\u0131nmas\u0131 \u00f6nem arz etmektedir. \u00c7al\u0131\u015f\u0131lmayan s\u00fcre i\u00e7erisinde \u00e7al\u0131\u015fanlara \u00fccretleri \u00f6denmeye devam edilmesi gerekmekte olup, yapt\u0131r\u0131lacak telafi \u00e7al\u0131\u015fmas\u0131 i\u00e7in ise ilave \u00fccret \u00f6denmesi gerekmemektedir. <\/p>\n\n\n\n

          1. Koronavir\u00fcs Salg\u0131n\u0131 S\u00fcresince Uzaktan \u00c7al\u0131\u015fma Yap\u0131lmas\u0131<\/strong><\/li><\/ol>\n\n\n\n

            Uzaktan \u00e7al\u0131\u015fma \u0130\u015f Kanunu\u2019nun \u201c\u00c7a\u011fr\u0131 \u00dczerine \u00c7al\u0131\u015fma ve Uzaktan \u00c7al\u0131\u015fma\u201d<\/strong> ba\u015fl\u0131kl\u0131 14. maddesinde d\u00fczenlenmektedir. <\/strong>\u0130\u015f Kanunu\u2019nun 14. Maddesi uyar\u0131nca, \u00e7al\u0131\u015fan i\u015f g\u00f6rme borcunu teknolojik ileti\u015fim ara\u00e7lar\u0131 ile i\u015fyeri d\u0131\u015f\u0131nda ya da evinde de yerine getirebilir. Ancak i\u015fbu madde h\u00fckm\u00fcne istinaden ge\u00e7ici olarak evden \u00e7al\u0131\u015fma karar\u0131 alacak i\u015fverenlerin, bu durumu yaz\u0131l\u0131 olarak kural alt\u0131na almas\u0131, \u00e7al\u0131\u015fanlar\u0131n evden \u00e7al\u0131\u015fma bi\u00e7imlerin belirlemesi ve buna y\u00f6nelik olarak gerekli \u00e7al\u0131\u015fma d\u00fczenini kurmas\u0131 gerekmektedir. Ayr\u0131ca \u00e7al\u0131\u015fanlar\u0131n s\u00f6zle\u015fme \u015fartlar\u0131 aynen korunarak ge\u00e7ici olarak evden \u00e7al\u0131\u015fmay\u0131 kabul ettiklerine dair yaz\u0131l\u0131 onay vermeleri uygun olacakt\u0131r. Uzaktan \u00e7al\u0131\u015fman\u0131n \u00e7al\u0131\u015fan\u0131n i\u015fyerinde fiilen bulunmas\u0131n\u0131 gerektiren pres,dolum,y\u00fckleme,\u00fcretim gibi i\u015flerde ger\u00e7ekle\u015ftirilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n\n\n\n

            1. \u00c7al\u0131\u015fan\u0131n Riskli Olarak Tan\u0131mlanan ve Tedbir Al\u0131nan \u00dclkelerden Gelmesi Durumunun \u0130\u015f Akdine Etkisi<\/strong><\/li><\/ol>\n\n\n\n

              Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 Halk Sa\u011fl\u0131\u011f\u0131 M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan 04.03.2020\u2019de yay\u0131mlanan yaz\u0131ya g\u00f6re; ki\u015finin riskli olarak tan\u0131mlanan ve tedbir al\u0131nan \u00fclkelerden gelmesi halinde izolasyon tedbiri uygulanmas\u0131 veya \u00f6nerilmesi durumunda, \u00e7al\u0131\u015fanlar\u0131n talepleri durumunda aile hekimlerine veya sa\u011fl\u0131k kurulu\u015flar\u0131na ba\u015fvurmalar\u0131 halinde pasaport bilgileri teyidi sonras\u0131nda yurda giri\u015f yapt\u0131\u011f\u0131 tarih dikkate al\u0131narak 14 g\u00fcne tamamlanmak \u00fczere  \u2018Z03.8 ve Z03.9 \u015f\u00fcpheli hastal\u0131k tan\u0131 kodlar\u0131 ile sa\u011fl\u0131k raporu alabileceklerdir. <\/p>\n\n\n\n

              1. \u0130\u015fveren veya \u0130\u015fyerinde \u00c7al\u0131\u015fan Ba\u015fka Bir \u0130\u015f\u00e7inin Enfekte Olmas\u0131ndan Dolay\u0131 \u0130\u015f\u00e7inin \u0130\u015f Akdinin Hakl\u0131 Nedenle Feshi <\/strong><\/li><\/ol>\n\n\n\n

                \u0130\u015f Kanunu\u2019nun. 24. maddesinin 1. f\u0131kras\u0131nda derhal feshe sebebiyet veren sa\u011fl\u0131k sebepleri d\u00fczenlenmi\u015ftir. H\u00fckm\u00fcn 1. F\u0131kras\u0131n\u0131n (b) bendi uyar\u0131nca, \u201c\u0130\u015f\u00e7inin s\u00fcrekli olarak yak\u0131ndan ve do\u011frudan bulu\u015fup g\u00f6r\u00fc\u015ft\u00fc\u011f\u00fc i\u015fveren yahut ba\u015fka bir i\u015f\u00e7i bula\u015f\u0131c\u0131 veya i\u015f\u00e7inin i\u015fi ile ba\u011fda\u015fmayan bir hastal\u0131\u011fa tutulursa\u201d i\u015f\u00e7i i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle derhal feshedebilir.\u2019\u2019<\/em><\/strong>Dolay\u0131s\u0131yla i\u015fveren veya i\u015fyerinde \u00e7al\u0131\u015fan ba\u015fka bir i\u015f\u00e7inin Koronavir\u00fcs nedeniyle enfekte olmas\u0131 i\u015f\u00e7inin hakl\u0131 nedenle i\u015f s\u00f6zle\u015fmesini derhal feshetmesi i\u00e7in yeterlidir.<\/p>\n\n\n\n

                \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerinin al\u0131nmamas\u0131 halinde de i\u015f\u00e7i, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n uygulanmamas\u0131 nedeniyle \u0130\u015f Kanunu\u2019nun 24. maddesinin 2. f\u0131kras\u0131n\u0131n (f) bendi uyar\u0131nca i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilir.<\/p>\n\n\n\n

                1. \u0130\u015f\u00e7inin Koronavir\u00fcs Nedeniyle \u00dccretsiz \u0130zne \u00c7\u0131kar\u0131lmas\u0131<\/strong><\/li><\/ol>\n\n\n\n

                  \u0130\u015f\u00e7inin i\u015fveren taraf\u0131ndan \u00fccretsiz izne \u00e7\u0131kar\u0131lmas\u0131, \u0130\u015f Kanunu\u2019nun \u2018\u2019\u00c7al\u0131\u015fma Ko\u015fullar\u0131nda De\u011fi\u015fiklik ve \u0130\u015f S\u00f6zle\u015fmesinin Feshi\u2019\u2019 ba\u015fl\u0131kl\u0131 22. maddesi kapsam\u0131nda de\u011ferlendirilecektir. <\/p>\n\n\n\n

                  \u0130\u015f Kanunu Madde 22<\/em><\/strong> : \u2018\u2019\u0130\u015fveren, i\u015f s\u00f6zle\u015fmesiyle veya i\u015f s\u00f6zle\u015fmesinin eki niteli\u011findeki personel y\u00f6netmeli\u011fi ve benzeri kaynaklar ya da i\u015fyeri uygulamas\u0131yla olu\u015fan \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 bir de\u011fi\u015fikli\u011fi ancak durumu i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirmek suretiyle yapabilir. Bu \u015fekle uygun olarak yap\u0131lmayan ve i\u015f\u00e7i taraf\u0131ndan  alt\u0131 i\u015fg\u00fcn\u00fc i\u00e7inde yaz\u0131l\u0131 olarak  kabul edilmeyen de\u011fi\u015fiklikler i\u015f\u00e7iyi ba\u011flamaz. \u0130\u015f\u00e7i de\u011fi\u015fiklik \u00f6nerisini bu s\u00fcre i\u00e7inde kabul etmezse, i\u015fveren de\u011fi\u015fikli\u011fin ge\u00e7erli bir nedene dayand\u0131\u011f\u0131n\u0131 veya fesih i\u00e7in ba\u015fka bir ge\u00e7erli nedenin bulundu\u011funu yaz\u0131l\u0131 olarak a\u00e7\u0131klamak ve bildirim s\u00fcresine uymak suretiyle i\u015f s\u00f6zle\u015fmesini feshedebilir. \u0130\u015f\u00e7i bu durumda 17 ila 21 inci madde h\u00fck\u00fcmlerine g\u00f6re dava a\u00e7abilir.\u2019\u2019<\/em><\/p>\n\n\n\n

                   Buna g\u00f6re; i\u015fveren, i\u015f\u00e7iyi \u00fccretsiz izne \u00e7\u0131karma karar\u0131n\u0131, i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirmek zorundad\u0131r.<\/strong> Yaz\u0131l\u0131 \u015fekilde yap\u0131lmayan ve i\u015f\u00e7i taraf\u0131ndan alt\u0131 i\u015fg\u00fcn\u00fc i\u00e7inde yaz\u0131l\u0131 olarak kabul edilmeyen de\u011fi\u015fiklikler i\u015f\u00e7iyi ba\u011flamaz. <\/p>\n\n\n\n

                  \u0130\u015f\u00e7i \u00fccretsiz izne \u00e7\u0131kar\u0131lmay\u0131 alt\u0131 i\u015fg\u00fcn\u00fc i\u00e7inde yaz\u0131l\u0131 olarak kabul etmezse, i\u015fveren de\u011fi\u015fikli\u011fin ge\u00e7erli bir nedene dayand\u0131\u011f\u0131n\u0131 veya fesih i\u00e7in ba\u015fka bir ge\u00e7erli nedenin bulundu\u011funu yaz\u0131l\u0131 olarak a\u00e7\u0131klamak bildirim s\u00fcresine uymak \u015fartlar sa\u011flan\u0131yorsa tazminat \u00f6demek suretiyle,  i\u015f s\u00f6zle\u015fmesini feshedebilir. \u0130\u015fveren, i\u015f\u00e7iyi \u00fccretsiz izne \u00e7\u0131karma karar\u0131n\u0131 yaz\u0131l\u0131 olarak bildirir ve i\u015f\u00e7i de bunu yaz\u0131l\u0131 olarak kabul ederse, i\u015f s\u00f6zle\u015fmesi \u00fccretsiz izin s\u00fcresince ask\u0131ya al\u0131nm\u0131\u015f olur. \u0130\u015fverenin i\u015f\u00e7iyi r\u0131zas\u0131 olmaks\u0131z\u0131n \u00fccretsiz izne \u00e7\u0131karmas\u0131 durumunda Yarg\u0131tay i\u00e7tihatlar\u0131 do\u011frultusunda i\u015f s\u00f6zle\u015fmesinin i\u015fveren taraf\u0131ndan eylemli olarak feshedildi\u011fi de\u011ferlendirilmektedir. Bu nedenle i\u015f\u00e7inin \u00fccretsiz izne muvafakati bulunmamas\u0131 halinde i\u015fverenin \u00e7al\u0131\u015fana \u00fccretli izin vermesi, telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131lmas\u0131 veya ge\u00e7ici olarak \u00e7al\u0131\u015fman\u0131n evden yap\u0131lmas\u0131 se\u00e7enekleri de\u011ferlendirilmeli, feshin son \u00e7are olmas\u0131 ilkesine uygun hareket edilmelidir. <\/p>\n\n\n\n

                  \u2018\u2019Dairemizce, i\u015fverenin tek tarafl\u0131 olarak \u00fccretsiz izin uygulamas\u0131na gitmesi halinde, bunu kabul etmeyen i\u015f\u00e7i y\u00f6n\u00fcnden \u201ci\u015fverenin feshi\u201d olarak de\u011ferlendirilmektedir.\u201d<\/em><\/p>\n\n\n\n

                  1. \u0130\u015f Akdinin \u0130\u015fveren Taraf\u0131ndan Koronavir\u00fcs Nedeniyle Feshedilmesinin \u0130\u015fe \u0130ade ve K\u0131dem-\u0130hbar Tazminat\u0131 Y\u00f6n\u00fcnden De\u011ferlendirilmesi<\/strong><\/li><\/ol>\n\n\n\n

                    \u0130\u015fverenin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle derhal fesih hakk\u0131, 4857 say\u0131l\u0131 \u0130\u015f Kanununun 25. maddesinde d\u00fczenlenmi\u015ftir. \u0130\u015fbu maddenin \u2018\u2019Zorlay\u0131c\u0131 Sebepler\u2019\u2019 ba\u015fl\u0131kl\u0131 3. bendi uyar\u0131nca \u2018\u2019\u0130\u015f\u00e7iyi i\u015fyerinde bir haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131 bir sebebin ortaya \u00e7\u0131kmas\u0131\u2019\u2019<\/em> halinde i\u015fveren i\u015f akdini hakl\u0131 nedenle derhal feshedebilir.<\/p>\n\n\n\n

                     Bu h\u00fckm\u00fcn d\u00fczenledi\u011fi zorlay\u0131c\u0131 sebepler i\u015fyerinden de\u011fil, i\u015f\u00e7iden kaynaklanmal\u0131 <\/strong>ve bunun sonucunda i\u015f\u00e7i kusuru olmaks\u0131z\u0131n i\u015f g\u00f6rme edimini ge\u00e7ici olarak yerine getirememelidir. \u0130\u015f s\u00f6zle\u015fmesinin feshine neden olan zorlay\u0131c\u0131 sebep i\u015f\u00e7iden kaynaklanm\u0131yorsa<\/strong> bu durum i\u015fverene hakl\u0131 nedenle fesih imkan\u0131 tan\u0131mamaktad\u0131r. Bu durumda i\u015fveren Koronavir\u00fcs nedeniyle i\u015f\u00e7iden kaynaklanmayan zorlay\u0131c\u0131 nedenlerle i\u015f akdini feshederse bu feshin ge\u00e7erlili\u011fi bulunmad\u0131\u011f\u0131ndan kanunda yer alan di\u011fer \u015fartlar\u0131n sa\u011flanmas\u0131 halinde i\u015f\u00e7inin i\u015fe iadeye ve k\u0131dem-ihbar tazminat\u0131na hak kazanaca\u011f\u0131 kanaatindeyiz. Ayr\u0131ca 18 Mart 2020 tarihli Koronavir\u00fcs De\u011ferlendirme Toplant\u0131s\u0131 sonras\u0131nda a\u00e7\u0131klanan Ekonomik \u0130stikrar Kalkan\u0131 ad\u0131 verilen paketteki imkanlardan istifade edecek firmalar i\u00e7in \u00f6n \u015fart\u0131n, istihdam kayb\u0131na yol a\u00e7mamak oldu\u011fu \u00f6nemle vurgulanm\u0131\u015ft\u0131r. <\/p>\n\n\n\n

                    \u0130\u015f Kanunu\u2019nun 24. maddesinin 3. bendi uyar\u0131nca i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek zorlay\u0131c\u0131 sebepler ortaya \u00e7\u0131kmas\u0131 halinde i\u015f\u00e7inin i\u015f akdini hakl\u0131 nedenle derhal feshetme imkan\u0131 bulunmaktad\u0131r. \u0130\u015f Kanunu\u2019nun 40. maddesi uyar\u0131nca zorlay\u0131c\u0131 sebep nedeniyle \u00e7al\u0131\u015ft\u0131r\u0131lmayan i\u015f\u00e7iye bu bekleme s\u00fcresi i\u00e7inde bir haftaya kadar yar\u0131m \u00fccret \u00f6denir.  S\u00f6z konusu fesih hakk\u0131n\u0131n kullan\u0131labilmesi i\u00e7in i\u015fyerinde i\u015fin bir haftadan uzun s\u00fcre durmas\u0131 ve zorlay\u0131c\u0131 sebebin i\u015f\u00e7iden de\u011fil i\u015fyerinden kaynaklanmas\u0131 gerekmektedir. <\/p>\n\n\n\n

                    Koronavir\u00fcs nedeniyle kamu otoritesinin karar\u0131 neticesinde i\u015fyerlerinin kapat\u0131lmas\u0131n\u0131n i\u015fyerinden kaynaklanan zorlay\u0131c\u0131 sebep te\u015fkil edip etmeyece\u011fi tart\u0131\u015fmaya a\u00e7\u0131kt\u0131r. Kanaatimizce bu durum her ne kadar kamu otoritesinin karar\u0131 neticesinde ger\u00e7ekle\u015fmi\u015f olsa da i\u015f\u00e7iden kaynaklanmay\u0131p i\u015fyerinden kaynaklanan zorlay\u0131c\u0131 sebep te\u015fkil edece\u011finden i\u015f\u00e7i i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilecektir. Bu durumda i\u015f\u00e7inin en az bir y\u0131ll\u0131k \u00e7al\u0131\u015fmas\u0131 varsa i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6denmesi gerekecektir. <\/p>\n\n\n\n

                    1. Koronavir\u00fcs\u00fcn K\u0131sa \u00c7al\u0131\u015fma \u00d6dene\u011fi Bak\u0131m\u0131ndan De\u011ferlendirilmesi<\/strong><\/li><\/ol>\n\n\n\n

                      K\u0131sa \u00e7al\u0131\u015fma uygulamas\u0131 bak\u0131m\u0131ndan zorlay\u0131c\u0131 sebepler \u2018\u2019\u0130\u015fverenin kendi sevk ve idaresinden kaynaklanmayan, \u00f6nceden kestirilemeyen, bunun sonucu olarak bertaraf edilmesine imk\u00e2n bulunmayan, ge\u00e7ici olarak \u00e7al\u0131\u015fma s\u00fcresinin azalt\u0131lmas\u0131 veya faaliyetin tamamen veya k\u0131smen durdurulmas\u0131 ile sonu\u00e7lanan d\u0131\u015fsal etkilerden kaynaklanan d\u00f6nemsel durumlar\u0131 ya da deprem, yang\u0131n, su bask\u0131n\u0131, heyelan, salg\u0131n hastal\u0131k, seferberlik gibi durumlar\u2019\u2019 <\/em>olarak tan\u0131mlanmaktad\u0131r. 18 Mart 2020 tarihli Koronavir\u00fcs De\u011ferlendirme Toplant\u0131s\u0131\u2019nda al\u0131nan karar neticesinde k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi devreye al\u0131narak, bundan faydalanmak i\u00e7in gereken s\u00fcre\u00e7lerin kolayla\u015ft\u0131r\u0131lmas\u0131 ve h\u0131zland\u0131r\u0131lmas\u0131na karar verilmi\u015ftir. B\u00f6ylece faaliyetine ara veren i\u015fyerlerindeki i\u015f\u00e7ilere ge\u00e7ici bir gelir deste\u011fi verirken, i\u015fverenlerin de maliyetini azaltmak ama\u00e7lanmaktad\u0131r. <\/p>\n\n\n\n

                        Yarg\u0131tay taraf\u0131ndan karar verilmi\u015f benzer bir salg\u0131n hastal\u0131k olan H1N1 vir\u00fcs\u00fc \u00fczerinden durum de\u011ferlendirilecektir.<\/p>\n\n\n\n

                        \u2018\u2019Somut olayda, t\u0131r \u015fof\u00f6r\u00fc olan davac\u0131 murisinin 26.11.2009 tarihinde daval\u0131 i\u015fveren taraf\u0131ndan Ukrayna\u2019ya sefere g\u00f6nderildi\u011fi, 11.12.2009 tarihinde T\u00fcrkiye\u2019ye giri\u015f yapt\u0131\u011f\u0131, Adli T\u0131p Kurumu raporunda, H1N1 vir\u00fcs\u00fcn\u00fcn kulu\u00e7ka s\u00fcresinin 1-4 g\u00fcn aras\u0131nda de\u011fi\u015fti\u011fi, murisin 13.12.2009 tarihli hastaneye ba\u015fvurusunda belirtti\u011fi \u015fikayetlerin hastal\u0131\u011f\u0131n ba\u015flang\u0131\u00e7 belirtileri oldu\u011fu takdirde hastal\u0131\u011f\u0131n bula\u015fmas\u0131n\u0131n bu tarihten 1-4 g\u00fcn \u00f6ncesinde ger\u00e7ekle\u015fmi\u015f olaca\u011f\u0131n\u0131n bildirildi\u011fi, <\/em>buna g\u00f6re davac\u0131 murisinin, i\u015fveren taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan i\u015f nedeniyle Ukrayna\u2019ya yap\u0131lan sefer s\u0131ras\u0131nda bula\u015ft\u0131\u011f\u0131 yukar\u0131da belirtilen rapor kapsam\u0131ndan anla\u015f\u0131lan H1N1 vir\u00fcs\u00fcne ba\u011fl\u0131 olarak, daha sonra meydana gelen \u00f6l\u00fcm\u00fcn\u00fcn i\u015f kazas\u0131 olarak kabul edilmesi gerekti\u011fi a\u00e7\u0131kt\u0131r\u2026\u2019\u2019<\/em><\/strong><\/p>\n\n\n\n

                        Yukar\u0131da yer alan Yarg\u0131tay karar\u0131nda, t\u0131r \u015fof\u00f6r\u00fcn\u00fcn i\u015fveren taraf\u0131ndan Ukrayna\u2019ya sefere g\u00f6nderildi\u011fi s\u0131rada bula\u015ft\u0131\u011f\u0131 anla\u015f\u0131lan H1N1 vir\u00fcs\u00fcne ba\u011fl\u0131 olarak daha sonra meydana gelen \u00f6l\u00fcm\u00fcn\u00fcn i\u015f kazas\u0131 olarak kabul edilmesi gerekti\u011fine karar verilmi\u015ftir. Kanaatimizce Yarg\u0131tay\u2019\u0131n H1N1 vir\u00fcs\u00fc hakk\u0131nda vermi\u015f oldu\u011fu bu karar Koronavir\u00fcs i\u00e7in de emsal te\u015fkil edebilecek niteliktedir. <\/p>\n\n\n\n

                        \u00c7al\u0131\u015fmam\u0131zda yer alan a\u00e7\u0131klamalar\u0131m\u0131zdan da anla\u015f\u0131laca\u011f\u0131 \u00fczere Koronavir\u00fcs \u00e7al\u0131\u015fanlar ve i\u015fverenler a\u00e7\u0131s\u0131ndan bir\u00e7ok hukuki sorunu beraberinde getirmektedir.
