\t \u00dclkemizde de olumsuz etkilerini g\u00f6stermeye ba\u015flayan Koronavir\u00fcs\u2019\u00fcn, kira s\u00f6zle\u015fmelerine y\u00f6nelik mevcut veya olas\u0131 hukuki etkileri hakk\u0131nda kar\u015f\u0131m\u0131za \u00e7\u0131kabilecek sorunlara ili\u015fkin haz\u0131rlam\u0131\u015f oldu\u011fumuz \u00e7al\u0131\u015fmam\u0131z a\u015fa\u011f\u0131da de\u011ferlendirmelerinize sunulmu\u015ftur. <\/p>\n\n\n\n

\t Hukukumuzda kira s\u00f6zle\u015fmeleri T\u00fcrk Bor\u00e7lar Kanunu m. 299 – m. 378 aras\u0131nda d\u00fczenlenmi\u015ftir. T\u00fcrk Bor\u00e7lar Kanunu’nda kiraya verenin bor\u00e7lar\u0131 teslim borcu ve esasl\u0131 onar\u0131mlar; kirac\u0131n\u0131n bor\u00e7lar\u0131 kira bedelini ve yan giderlerini \u00f6deme borcu, kiralanan\u0131 kullanma ve i\u015fletme borcu ve bak\u0131m borcu olarak say\u0131lm\u0131\u015ft\u0131r. <\/p>\n\n\n\n

\t Yukar\u0131da da belirtti\u011fimiz \u00fczere kirac\u0131 genel olarak kira bedelini \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. Kirac\u0131, kiralanan\u0131n tesliminden sonra muaccel olan kira bedelini veya yan gideri \u00f6deme borcunu ifa etmezse, kiraya veren kirac\u0131ya konut ve \u00e7at\u0131l\u0131 i\u015fyeri kira s\u00f6zle\u015fmelerinde en az 30 g\u00fcn, di\u011fer kira s\u00f6zle\u015fmelerindeen az 10 g\u00fcnl\u00fck s\u00fcre verip, bu s\u00fcrede de ifa etmeme durumunda, s\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir. <\/p>\n\n\n\n

\t Ancak kirac\u0131 ile kiraya veren aras\u0131nda akdedilen kira s\u00f6zle\u015fmeleri feshedilemez de\u011fildir. Kira s\u00f6zle\u015fmelerinde taraflar\u0131n edimlerini yerine getirememeleri halinde durumun \u015fartlar\u0131na ve etkinin \u015fiddetine g\u00f6re TBK\u2019n\u0131n ifa imk\u00e2ns\u0131zl\u0131\u011f\u0131na ili\u015fkin 136. maddesinin Borcun ifas\u0131 bor\u00e7lunun sorumlu tutulamayaca\u011f\u0131 sebeplerle imk\u00e2ns\u0131zla\u015f\u0131rsa, bor\u00e7 sona erer<\/em>.”<\/strong> veya a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fcne ili\u015fkin 138. maddesi”S\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada taraflarca \u00f6ng\u00f6r\u00fclmeyen ve \u00f6ng\u00f6r\u00fclmesi de beklenmeyen ola\u011fan\u00fcst\u00fc bir durum, bor\u00e7ludan kaynaklanmayan bir sebeple ortaya \u00e7\u0131kar ve s\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada mevcut olgular\u0131, kendisinden ifan\u0131n istenmesini d\u00fcr\u00fcstl\u00fck kurallar\u0131na ayk\u0131r\u0131 d\u00fc\u015fecek derecede bor\u00e7lu aleyhine de\u011fi\u015ftirir ve bor\u00e7lu da borcunu hen\u00fcz ifa etmemi\u015f veya ifan\u0131n a\u015f\u0131r\u0131 \u00f6l\u00e7\u00fcde g\u00fc\u00e7le\u015fmesinden do\u011fan haklar\u0131n\u0131 sakl\u0131 tutarak ifa etmi\u015f olursa bor\u00e7lu, h\u00e2kimden s\u00f6zle\u015fmenin yeni ko\u015fullara uyarlanmas\u0131n\u0131 isteme, bu m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde s\u00f6zle\u015fmeden d\u00f6nme hakk\u0131na sahiptir. S\u00fcrekli edimli s\u00f6zle\u015fmelerde bor\u00e7lu, kural olarak d\u00f6nme hakk\u0131n\u0131n yerine fesih hakk\u0131n\u0131 kullan\u0131r.” <\/em><\/strong>uygulama alan\u0131 bulmas\u0131 g\u00fcndeme gelebilecektir. Kira s\u00f6zle\u015fmeleri de s\u00fcrekli edimli s\u00f6zle\u015fmelerden oldu\u011fun kira s\u00f6zle\u015fmelerinin taraflar\u0131 s\u00f6zle\u015fmeden d\u00f6nme hakk\u0131 yerine fesih hakk\u0131n\u0131 kullanacakt\u0131r.<\/p>\n\n\n\n

\t A\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc i\u00e7erisinde bulunan taraf\u0131n edimini uyarlama davas\u0131 a\u00e7aca\u011f\u0131na ili\u015fkin ihtirazi kay\u0131t d\u00fc\u015ferek yerine getirmesi uygun olacakt\u0131r. Bu husus Yarg\u0131tay kararlar\u0131 ile de sabittir. <\/p>\n\n\n\n

”S\u00f6zle\u015fme hukukuna egemen olan s\u00f6zle\u015fmeye ba\u011fl\u0131l\u0131k ( Ahde Vefa -Pacta Sund Servande ) ilkesine g\u00f6re, s\u00f6zle\u015fme yap\u0131ld\u0131\u011f\u0131 andaki gibi uygulanmal\u0131d\u0131r. S\u00f6zle\u015fme ko\u015fullar\u0131 bor\u00e7lu i\u00e7in sonradan a\u011f\u0131rla\u015fm\u0131\u015f, kararla\u015ft\u0131r\u0131lan edimler dengesi sonradan \u00e7\u0131kan olaylar nedeniyle de\u011fi\u015fmi\u015f olsa bile, bor\u00e7lu s\u00f6zle\u015fmedeki edimini aynen ifa etmelidir. <\/em>Ancak, s\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131nda kar\u015f\u0131l\u0131kl\u0131 edimler aras\u0131nda olan denge sonradan \u015fartlar\u0131n ola\u011fan\u00fcst\u00fc de\u011fi\u015fmesiyle b\u00fcy\u00fck \u00f6l\u00e7\u00fcde taraflar\u0131n biri aleyhine katlan\u0131lamayacak derecede bozulabilir. \u0130\u015fte bu durumda s\u00f6zle\u015fmeye ba\u011fl\u0131l\u0131k ve s\u00f6zle\u015fme adaleti ilkeleri aras\u0131nda bir \u00e7eli\u015fki has\u0131l olur ve art\u0131k bu ilkeye s\u0131k\u0131 s\u0131k\u0131ya ba\u011fl\u0131 kalmak adalet, hakkaniyet ve objektif h\u00fcsn\u00fcniyet ( TMK m. 4, 2 ) kaidelerine ayk\u0131r\u0131 bir durum yarat\u0131r hale gelir. Hukukta bu z\u0131tl\u0131k ( Clausula Rebus Sic Stantibus -Beklenmeyen Hal \u015eart\u0131) s\u00f6zle\u015fmenin de\u011fi\u015fen \u015fartlara uydurulmas\u0131 ilkesi ile giderilmeye \u00e7al\u0131\u015f\u0131lmaktad\u0131r. Taraflar\u0131n iradelerini etkileyip s\u00f6zle\u015fmeyi yapmalar\u0131na neden olan \u015fartlar daha sonra \u00f6nemli surette de\u011fi\u015fmi\u015fse art\u0131k taraflar o akitle ba\u011fl\u0131 tutulamazlar, de\u011fi\u015fen ko\u015fullar kar\u015f\u0131s\u0131nda TMK\u2019n\u0131n 2. maddesi uyar\u0131nca s\u00f6zle\u015fmenin yeniden d\u00fczenlenmesi imkan\u0131 has\u0131l olur.<\/em><\/strong> ”<\/em> (<\/strong>YARGITAY 815\/835 HGK 18.11.1998 TAR\u0130H)<\/strong><\/p>\n\n\n\n

”Taraflar\u0131n iradelerini etkileyip s\u00f6zle\u015fmeyi yapmalar\u0131na neden olan \u015fartlar daha sonra \u00f6nemli surette de\u011fi\u015fmi\u015fse art\u0131k taraflar o akitle ba\u011fl\u0131 tutulamazlar, de\u011fi\u015fen ko\u015fullar kar\u015f\u0131s\u0131nda kira bedelinden gerekli indirimin yap\u0131lmas\u0131 gerekebilir.<\/em><\/strong> Davac\u0131, a\u00e7\u0131klanan nedenlerle kira bedellerinde ve kiralama \u015fartlar\u0131nda uyarlama talep etmi\u015ftir. Dava konusu zeytinliklerdeki verim d\u00fc\u015f\u00fckl\u00fc\u011f\u00fcn\u00fcn ger\u00e7ek sebebinin a\u015f\u0131r\u0131 kurakl\u0131k oldu\u011fu belirlenmi\u015f olmas\u0131na g\u00f6re mahkemece, davac\u0131n\u0131n talepleri do\u011frultusunda bir karar verilmesi gerekir.”<\/em> (<\/strong>T.C. Ayr\u0131ca TBK m. 331’de taraflardan her birine kira ili\u015fkisinin devam\u0131 kendisi i\u00e7in \u00e7ekilmez hale getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 halinde s\u00f6zle\u015fmeyi feshetme hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. <\/p>\n\n\n\n

TBK m. 331-\u00d6nemli sebepler<\/strong><\/p>\n\n\n\n

”Taraflardan her biri, kira ili\u015fkisinin devam\u0131n\u0131 kendisi i\u00e7in \u00e7ekilmez h\u00e2le getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 durumunda, s\u00f6zle\u015fmeyi yasal fesih bildirim s\u00fcresine uyarak her zaman feshedebilir.<\/em><\/p>\n\n\n\n

H\u00e2kim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flar.”<\/em><\/p>\n\n\n\n

\tYukar\u0131da da belirtti\u011fimiz \u00fczere; e\u011fer kullanma kirac\u0131n\u0131n veya kiraya verenin \u015fahs\u0131ndan kaynaklanan bir durumdan de\u011fil de objektif imkans\u0131zl\u0131ktan dolay\u0131 olanaks\u0131z ise bu durumda kira borcu kusursuz imkans\u0131zl\u0131k nedeniyle ortadan kalkar. \u00d6rne\u011fin kiralanan\u0131n tamamen yanmas\u0131 veya binada \u00e7\u0131kan bula\u015f\u0131c\u0131 hastal\u0131k nedeniyle kiralanana girilememesi hallerinde durum b\u00f6yledir. \t 26.07.2007 tarihli Resmi Gazete EK-5’te yay\u0131mlanan Tahsisli Ta\u015f\u0131nmazlardaki Ticari Ama\u00e7la Kullan\u0131lacak Yerlere Ait Kira S\u00f6zle\u015fmesi m.11’de kirac\u0131n\u0131n bula\u015f\u0131c\u0131 hastal\u0131k, salg\u0131n gibi olaylar\u0131n \u00e7\u0131kmas\u0131 gibi s\u00f6zle\u015fmenin d\u00fczenlenmesinden sonra ortaya \u00e7\u0131kan hallerde kirac\u0131n\u0131n kira s\u00fcresinin uzat\u0131m\u0131, kira bedelinin indirilmesi, \u00f6deme tarihi ve miktarlar\u0131n\u0131n, kiralanan alan\u0131n y\u00fcz\u00f6l\u00e7\u00fcm\u00fcn\u00fcn de\u011fi\u015ftirilmesi vb. taleplerde bulunabilece\u011fi d\u00fczenlenmi\u015ftir. ”Tabii afetler (yang\u0131n, deprem, su bask\u0131n\u0131 vs.), \u00fclkede genel veya tesisin bulundu\u011fu yerde k\u0131smi seferberlik ilan\u0131, genel veya k\u0131smi grev, lokavt gibi k\u0131smi hak kullan\u0131m\u0131ndan do\u011fan imk\u00e2ns\u0131zl\u0131klar\u0131n meydana gelmesi,<\/em> bula\u015f\u0131c\u0131 hastal\u0131k, salg\u0131n gibi olaylar\u0131n \u00e7\u0131kmas\u0131 ve benzeri h\u00e2ller gibi m\u00fccbir sebepler ile s\u00f6zle\u015fmenin d\u00fczenlenmesinden sonra ortaya \u00e7\u0131kan ve kamudan kaynaklanan hakk\u0131n kullan\u0131m\u0131n\u0131 engelleyen sebepler hari\u00e7 olmak \u00fczere, kirac\u0131 s\u00f6zle\u015fmenin devam\u0131 s\u00fcresince, kira s\u00fcresinin uzat\u0131m\u0131, kira bedelinin indirilmesi, \u00f6deme tarihi ve miktarlar\u0131n\u0131n, kiralanan alan\u0131n y\u00fcz\u00f6l\u00e7\u00fcm\u00fcn\u00fcn de\u011fi\u015ftirilmesi vb. talebinde bulunamaz.’<\/em><\/strong>‘<\/em><\/p>\n\n\n\n

\t Yukar\u0131da detayl\u0131ca a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z ifa imkans\u0131zl\u0131\u011f\u0131 ve a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc, ola\u011fan\u00fcst\u00fc fesih halleri ve a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc i\u00e7erisinde bulunan taraf\u0131n uyarlama davas\u0131 a\u00e7ma hallerini \u00fclkemizde olumsuz etkilerini g\u00f6stermeye ba\u015flayan Koranavir\u00fcs\u00fc a\u00e7\u0131s\u0131nda de\u011ferlendirmek gerekirse;<\/p>\n\n\n\n
